These terms govern your use of Uptime Tracker (the "Service") at uptimetracker.live, provided by the operator of Uptime Tracker ("we", "us"). By creating an account or using the Service you agree to them. If you use the Service for an organization, you confirm you may bind it to these terms.
1. The Service
Uptime Tracker checks websites, APIs and other internet services you configure, records the results, notifies the destinations you choose and publishes status pages you create. Checks run from the probe locations listed in the product; we do not claim independent multi-region confirmation unless the product says so for your monitors.
2. Accounts
- You sign in with a one-time link sent to your email address. Keep access to that mailbox secure; we recommend enabling two-factor authentication.
- You are responsible for everything done in your workspaces, including by people you invite and by API tokens you create.
- You must be at least 16 years old and give accurate account information.
3. Your content and targets
- You keep all rights to the configuration, credentials, incident notes and other content you submit ("Customer Data"). You grant us the rights needed to operate the Service for you.
- You may only monitor systems you own or are authorized to monitor, at a frequency their operators permit. Read the Acceptable Use Policy.
- Status pages, public incident updates and status-page subscriptions are public by design when you publish them. You are responsible for what you publish.
4. Plans, payment and prepaid SMS credit
- Paid plans are billed in advance, monthly or annually, through Stripe, in US dollars and excluding applicable taxes. Prices and plan limits are shown in the product at the time of purchase.
- Subscriptions renew automatically until cancelled. You can cancel at any time in the billing portal; cancellation takes effect at the end of the paid period and is not a deletion of your data.
- If a payment fails, we keep paid features for a 7-day grace period, then apply Free plan limits until payment succeeds. Monitors over a limit are paused, never deleted.
- SMS alerts are paid from prepaid credit (packages or top-ups). Credit is non-refundable except where required by law, does not expire while your account is active, and is consumed only for messages our SMS provider accepts. Prices per country are shown before purchase and may change for future purchases.
- We do not charge overages automatically; usage beyond your plan or credit is paused or refused.
- Except where required by law, fees already paid are non-refundable.
5. Service levels and limits
We work to keep the Service available and accurate, but monitoring depends on networks, third-party providers and the targets themselves. Unless a separate written agreement says otherwise, the Service is provided without a guaranteed uptime commitment. Alerts can be delayed or missed; do not rely on the Service as your only safety mechanism for life-critical or safety-critical systems.
6. Suspension and termination
We may suspend or limit accounts that violate these terms or the Acceptable Use Policy, create risk for others, or are unpaid, with notice where reasonable. You may delete your workspace at any time; deletion is permanent. We may end the Service with at least 30 days' notice and will let you export your data before that.
7. Disclaimers
To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement.
8. Limitation of liability
To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, arising from the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the event giving rise to the claim (or US$100 if greater for free accounts). These limits do not apply where the law does not allow them.
9. Indemnity
You will defend and indemnify us against third-party claims arising from systems you monitor without authorization or from content you publish through the Service.
10. Changes
We may update these terms. Material changes take effect 30 days after we notify account owners by email or in the product; continuing to use the Service after that means you accept them.
11. Governing law
These terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules, and disputes will be resolved in the state or federal courts located there, unless mandatory consumer law of your country of residence provides otherwise.
